Terms of Service

Introduction

GPTPowerUps is a browser extension and curated plugin marketplace that adds concrete productivity features to your AI assistants: ChatGPT, Claude, and Grok. ElPi Corp, the publisher, is a French company — these Terms define what you can do with the service, and what we do for you.

• The core service is free forever — no credit card required to get started.
• Paid tiers are opt-in and TBA — you choose if and when you upgrade.
• Your rights are respected: 14-day money-back guarantee, one-click cancellation, your data stays yours.

License to use

In plain English: Short version: you can use GPTPowerUps on your own devices, for your own use. You cannot resell it, copy it, or reverse-engineer it (with narrow exceptions for interoperability and security research required by EU law). We own the code; you own your data.

By installing or using GPTPowerUps, you receive a non-exclusive, revocable, non-transferable, personal-use license to:

• Install and use the GPTPowerUps browser extension on devices under your personal control.
• Access the curated plugin marketplace at gptpowerups.com.
• When a Cloud Sync tier is active (V2), access the sync API endpoints for your personal configuration storage.

This license does not include:

• Redistributing, reselling, white-labeling, or commercializing the extension or its content.
• Reverse engineering, decompiling, or disassembling the extension — except to the extent strictly authorized by applicable law for interoperability purposes (EU Software Directive 2009/24/EC, Article 6) or within the scope of good-faith security research under EU CRA 2024 recitals (you must notify ElPi Corp within 30 days of any vulnerability discovery).
• Sub-licensing to third parties.
• Using the extension features to exceed the usage quotas, rate limits, or automation restrictions imposed by ChatGPT/OpenAI, Claude/Anthropic, or Grok/xAI — including but not limited to automated mass querying, prompt injection at machine scale, or circumventing account-level usage caps set by those platforms.

ElPi Corp retains all intellectual property rights in GPTPowerUps: the extension, the brand, the marketplace content, and the cloud infrastructure. No title or ownership transfers to you.

Per Articles 11-14 of EU Cyber Resilience Act 2024, ElPi Corp commits to notifying ENISA and the national CSIRT in the event of an exploitable security incident affecting the extension.

Your obligations

In plain English: The rules are short and sensible. They protect other users and the AI platforms you rely on — not just ElPi Corp.

By using GPTPowerUps, you agree to the following rules:

1. 1No reverse engineering — no decompiling or disassembling the extension, except for the legal exceptions listed above (EU interoperability 2009/24/EC or EU CRA 2024 security research).
2. 2Respect host platform terms — ChatGPT (OpenAI), Claude (Anthropic), and Grok (xAI) each have their own Terms of Service. You are solely responsible for complying with them. GPTPowerUps does not shield you from suspension by those platforms.
3. 3No API rate-limit abuse — you do not use GPTPowerUps to exceed third-party host API quotas or to automate actions those hosts prohibit.
4. 4No illegal use — no use of GPTPowerUps for purposes contrary to French, EU, or other applicable laws.
5. 5No harassment, spam, or abuse — no use to harass, spam, or harm third parties.
6. 6No automated mass scraping — you do not use extension features to scrape host platforms at a scale or in a manner their policies prohibit.
7. 7Compliance with applicable laws — you use GPTPowerUps in compliance with all laws applicable to you, including data protection laws (GDPR).
8. 8Honest identity — you do not impersonate an employee or representative of ElPi Corp or GPTPowerUps in any context.

Account terms

At V1, no account is required. The extension runs entirely locally, with no authentication. Your preferences are stored in your browser, on your device. ElPi Corp receives no personal data from the free V1 tier.

If you join the beta waiting list (/beta or /extension pages), we collect only your email address — on explicit opt-in — to send you a launch notification. That email is not used for marketing without your separate consent. You can unsubscribe at any time via the one-click link in every email. See our Privacy Policy for full details.

To unsubscribe from the waiting list or delete your email, send a request to dpo@elpicorp.com or book a direct slot at — handled within the statutory GDPR response window.

Subscription (paid tiers — V2)

Paid tiers are entirely optional. The core of GPTPowerUps remains free forever.

Payment processor & currencies

Billing is handled by a third-party payment processor (to be confirmed at tier launch). By completing a purchase, you also accept the terms of use of the relevant payment processor. We never store or process your card details directly.

EUR as primary currency. USD as secondary currency.

Auto-renewal

Annual subscriptions renew automatically at the end of each period. ElPi Corp sends you a renewal reminder by email and in-extension at least 30 days before the renewal date. You can cancel at any time from your account dashboard, with one click, before the renewal date; cancellation takes effect at the end of the current billing period (Article R221-2 of the French Consumer Code + Directive (EU) 2019/2161).

Warranties

In plain English: Short version: we do our best, but we cannot guarantee the extension will work perfectly if ChatGPT, Claude, or Grok changes their interface. We are not affiliated with OpenAI, Anthropic, or xAI.

• GPTPowerUps is provided 'AS IS' and 'AS AVAILABLE' without warranties of any kind, express or implied — including no implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
• GPTPowerUps operates alongside third-party platforms (ChatGPT/OpenAI, Claude/Anthropic, and Grok/xAI). Those platforms may change their interfaces or APIs at any time without notice. ElPi Corp is not responsible for interruptions or malfunctions in GPTPowerUps caused by such changes. ElPi Corp is not affiliated with OpenAI, Anthropic, or xAI and is not their representative.
• During the V1 beta period, features may change, be removed, or be temporarily unavailable without notice. ElPi Corp does not guarantee continuous, uninterrupted, or error-free operation of the service.

Limitation of liability

In plain English: Short version: if something goes wrong, our financial liability to you is capped at what you paid us in the past year — or €100, whichever is more. French law protects you from us waiving our responsibility for serious faults.

Liability cap

ElPi Corp's total aggregate liability to you, for any claim arising under or related to these Terms or the service, is limited to the greater of: (a) the total fees you paid to ElPi Corp in the 12 months preceding the claim, or (b) €100.

Exclusions

ElPi Corp is not liable for indirect, incidental, special, exemplary, or consequential damages, or for any loss of profits, revenue, data, goodwill, or business opportunities — even if ElPi Corp was advised of the possibility of such damages. ElPi Corp is also not liable for damages caused by third-party host platform outages or changes, or by your violation of their terms of service.

Indemnification

In plain English: You cover us if you misuse the extension. We cover you if our own code causes a third-party IP claim against you. Mutual accountability.

You agree to defend, indemnify, and hold harmless ElPi Corp, its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising from: your misuse of GPTPowerUps; your violation of these Terms; your violation of any third-party rights (intellectual property, privacy); your violation of third-party host platform terms of service (OpenAI, Anthropic, xAI); or any illegal content you transmit through the service.

Termination

User-initiated termination

You can stop using GPTPowerUps at any time, immediately, with no notice required. For the free V1 tier: uninstall the extension — no data is held server-side. For a paid tier (V2): cancel from your account dashboard; access continues through the end of your paid period.

ElPi Corp-initiated termination

ElPi Corp may terminate your access for material breach of these Terms (including the obligations in 'Your obligations'), confirmed fraud, or legal requirement. In such cases, we send a written 10-day notice with an opportunity to remedy the breach — except for serious fraud, illegal activity, or serious harm to third parties, which may result in immediate suspension. ElPi Corp may also discontinue the service without cause with 90 days advance notice; in that case, prepaid fees for the remaining period are refunded on a pro-rata basis.

After termination

After termination of a Cloud Sync tier (V2): a 30-day grace period to export your data, then permanent deletion of all your cloud-stored content no later than 90 days after termination. A deletion confirmation email is sent to you. Waiting list emails: removed no later than 30 days after your unsubscribe request or on written request to dpo@elpicorp.com.

Governing law + jurisdiction

In plain English: Short version: if you have a problem, reach out directly first (email or calendar slot). If that does not resolve it, French consumer mediation (CM2C) is free and available for paid-tier disputes. Strasbourg courts are the last resort. EU consumer law gives you additional protection in your own country.

Applicable law

These Terms are governed by French law, including the Code de la consommation and the Code civil, supplemented by applicable EU regulations (GDPR, DSA, Consumer Rights Directive).

Jurisdiction

For B2B disputes: Tribunal de commerce de Strasbourg (Bas-Rhin, France). For B2C disputes: French courts with jurisdiction in the consumer's place of residence, or the Tribunal de Strasbourg at the consumer's option. For EU consumers outside France, the mandatory consumer protection laws of their country of residence apply in addition where they provide greater protection (Rome I Regulation, Article 6).

Bilingual governance

The French version of these Terms governs for consumers residing in France (Articles L611-1 et seq. of the French Consumer Code). The English version governs for all other users. In case of conflict between the two versions, the version applicable to the relevant user prevails.

Mediation

Mandatory prior mediation: before initiating any court proceedings, the parties must attempt mediation through a CECMC-accredited consumer mediator, pursuant to Article L612-1 of the French Consumer Code and Directive (EU) 2025/2647 (in force since January 19, 2026).

Mediation is free for the consumer. The process is confidential and non-binding until a settlement is signed.

Before escalating to formal mediation or court proceedings, we encourage direct resolution. Book a slot at — most issues are resolved in one conversation.

DSA compliance (Digital Services Act)

Prohibited content

GPTPowerUps is a curated marketplace. The following content or uses are prohibited on the platform: content illegal under EU and French law, harassment, spam, intellectual property violations, and any content contrary to these Terms.

Reporting & redress

Reporting mechanism: send any report to legal@elpicorp.com. ElPi Corp will acknowledge receipt and process your report as required by DSA Article 12.

Material changes notice

Any material change to these Terms (pricing, liability, refund policy, governing law, data handling, or user obligations) will be preceded by 30 days advance notice before taking effect (DSA Article 12).

Updates to these Terms

Notification

ElPi Corp notifies material changes via: in-extension banner for active users; email to waiting list subscribers, Cloud Sync, and Team tier members. Non-material changes (typo corrections, clarifications) may take effect immediately with notation in the version history.

Notice period

30 days before any material change takes effect (DSA + consumer law requirements).

Continued use = acceptance

Continued use of GPTPowerUps after the effective date of a material change constitutes your acceptance of the updated version. If you do not accept, you can terminate before the effective date without penalty.

For material changes to paid-tier pricing or your core rights, ElPi Corp may also offer a direct notification call slot at during the advance-notice window.

Miscellaneous

Severability

If any provision of these Terms is found invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions continue in full force and effect.

Entire agreement

These Terms, together with the Privacy Policy and, where applicable, the relevant purchase confirmation, constitute the entire agreement between you and ElPi Corp regarding GPTPowerUps. They supersede all prior agreements, representations, or understandings on the same subject matter.

No waiver

ElPi Corp's failure to enforce any right under these Terms does not constitute a waiver of that right. Any waiver must be in writing and signed by an authorized representative of ElPi Corp.

Assignment

ElPi Corp may assign these Terms or any rights or obligations under them to an affiliate or successor entity in a merger, acquisition, or sale of substantially all assets, with 30 days notice to users. You may not assign your rights or obligations under these Terms without ElPi Corp's prior written consent.

Force majeure

ElPi Corp is not liable for failures caused by circumstances beyond its reasonable control: acts of God, war, government actions, internet infrastructure failures, or outages of third-party host platforms (ChatGPT, Claude, and Grok).

Electronic contracting

Installing the extension and/or purchasing a subscription constitutes electronic acceptance of these Terms, valid and enforceable under French law (Loi pour la confiance dans l'économie numérique — LCEN 2004).

Third-party beneficiaries

These Terms confer no rights on third parties.

What you will never find in our Terms

These are not marketing claims. Each of the following is a direct answer to a documented anti-pattern in the AI extension market.

• No chargeback threat language. We will never threaten to ban you or delete your data if you dispute a charge with your bank.
• No automatic annual price increases. We will never increase your subscription price from one year to the next without your explicit renewed consent.
• No refusal of refunds. We guarantee a money-back period on all paid tiers — no questions asked, no exceptions, per Art. L221-24 of the French Consumer Code.
• No forced binding arbitration. We do not require you to waive your right to go to court. French consumer law and EU Directive 2025/2647 give you the right to choose mediation or court proceedings.
• No class-action waiver. You can join or lead a collective consumer action under applicable French and EU law.
• No Delaware Corp shell. ElPi Corp is a French company. Our legal entity, governing law, and jurisdiction are stated openly.
• No resale of your data. We do not sell, rent, or broker your personal data or your usage data to any third party, ever.
• No hidden limits. When a feature has a limit on a given tier, we publish it explicitly. 'Limits apply' with no number is not acceptable in our communication.
• No email required to use the extension. Installing GPTPowerUps requires no email, no account, no Google OAuth in V1.
• No watermark in your AI conversations. We never add a 'Created with GPTPowerUps' tag to any output.
